  1. 1. Prerequisites. Each driver shall be required to:
    • a. be 18 years of age or older
    • b. provide proof of a valid U.S. drivers license (must be in possession while driving)
    • c. have a clean drivers record as defined below
    • d. provide proof of active automobile insurance (must be in possession while driving) ; and have no restrictions to drive including needing any special equipment or aides to operate the vehicles
  2. 2. Driver disqualification
    • a. Major convictions within 3 years including the following (if Driver has any of these violations the Driver will be disqualified):
      • i. Driving under the influence of alcohol or drugs
      • ii. Refusal to take the breathalyzer test
      • iii. Reckless or careless driving
      • iv. Leaving the scene of an accident or hit and run
      • v. Drag racing on public roads
      • vi. Any other major violation or felony
    • b. Minor violations within 3 years, (if Driver's record totals greater than 5 points on the following scale, Driver will be disqualified):
      • i. Speeding (10 mph or less above limit)
        1 point
      • ii. Speeding (more than 10 mph)
        2 points
      • iii. All other violations
        2 points
      • iv. Accident (at fault)
        2 points

3. Damage Responsibility. Drivers operating Supercar Sensation, LLC vehicles are 100% liable for damage to Supercar Sensation, LLC vehicles while under their control or custody. All drivers who purchased experiences on or after 8/26/09 must submit a letter from their insurance carrier proving coverage of Supercar Sensation, LLC vehicles. Without proof of coverage, ALL drivers who purchase driving experiences on or after 8/26/09 will need to purchase supplemental insurance from Supercar Sensation, LLC. This group policy will limit driver’s liability to $5000 for accidental (non-deliberate) damage of Supercar Sensation, LLC vehicles. Drivers must still provide proof of insurance by presenting their insurance card or providing a refundable $5000 deposit. Supplemental insurance is also available for customers who purchased driving experiences prior to 8/26/09 and want to limit maximum participant liability to $5000.

4. Abuse of Vehicles. Customer will be liable for all repair costs associated with abusive driving of the Supercar Sensation, LLC vehicles. Abuse includes, but is not limited to the following. These activities are forbidden. Abusive use of vehicles may also result in immediate non-refundable expulsion from the driving experience.
a. Deactivation of traction control
b. Holding the brake while applying the throttle to launch the vehicle (this destroys the clutch immediately in the F1 transmission)
c. Over-revving of engine by missing a shift in a manual transmission car
d. Sustained high revving or excessive braking and accelerating.
e. Spilling beverages or food in vehicle, or smoking damage.
f. Any reckless use of vehicle, such as deliberate hitting of cones in autocross.

5. Additional Supercar Sensation Driving Rules. All participants agree to follow the rules as listed below. Failure to do so will result in immediate non-refundable expulsion from the driving experience. During all lead follow tours, it is the responsibility of the participant to stay on course and to stay within visual contact of the lead vehicle. Any deviation from the route may also result in expulsion and may result in a charge of $50 per mile for extra mileage driven. Drivers agree to NOT do any of the following: THESE ARE FORBIDDEN!!!!!
a. Driving the cars in a reckless fashion as judged in the sole discretion of Supercar Sensation, LLC and its employees or assigns;
b. Talking on a cell phone, two way radio (unless necessary), texting, emailing, or taking pictures while driving;
c. Tailgating or aggressive behavior, off-roading or driving off the designated route;
d. Deactivating traction control;
e. Smoking, chewing tobacco, or eating in vehicles;
f.Alcohol consumption within 8 hours of operation of vehicles. Any suspicion of alcohol or elicit drug use will result in a non-refundable expulsion;
g. Non-use of seat belts by all persons in operating vehicle

6. Annual Pass. Purchasers of the Annual Pass are eligible to participate in one drive per week. Only one driving experience may be booked at any given time. Pass holder is responsible for paying a usage fee as described in your contract. Supercar Sensation,LLC must have a minimum of 2 customers to participate on a one or two hour tour, and 4 customers to participate in a four hour tour. The Annual Pass holder must follow these rules as well. Special events are exempt from annual passholder activities.

7. Passengers. As of purchases after 6/12/09, passengers are eligible to come along on the one, two, or four hour tours or autocross at no charge. All passengers must sign the Supercar Sensation,LLC waiver. Passengers must be 8 years old or older, and the parent or guardian must sign the minor waiver form. It is the sole responsibility of the parent or guardian to safely secure the participating child.

8. Obeying the Laws. Drivers agree to abide by all federal, state and local laws while operating the vehicles. Supercar Sensation does not condone any speeding or reckless driving whatsoever. The driving segments are not timed, and customers must understand that the experience is not a rally or race. Participants are not allowed to use any radar detector units. Supercar Sensation,LLC takes no responsibility for any individual's failure to abide by the law.

9. Accident Protocol. If a driver is involved in an accident with a Supercar Sensation, LLC vehicle, the driver must immediately contact a Supercar representative. The Supercar representative will assist you with notification of the emergency personnel, tow vehicles, and so forth. Please file a police report and document details on all parties involved including names, addresses, insurance information, and take photographs if possible. Supercar Sensation, LLC will do its best to provide an alternate vehicle to complete your experience if possible. If Supercar Sensation staff feels that you are unfit to continue, then you will be no longer allowed to drive for the remainder of the experience.

10. Supercar Problems. Drivers shall notify Supercar Staff if a vehicle is malfunctioning or otherwise in need of repair or service. Supercar will remove said vehicle from operation if malfunction is felt to be in any way a danger to the occupants or to the public.

11. Cancellation. All purchases are non-refundable. Should a participant need to reschedule, notification must be made at least 72 hours prior to an event. Failure to do so will result in a $50 rebooking fee.

12. Personal Belongings. Supercar shall not be responsible for a participant's or passenger's personal belongings that are brought to an event or into a supercar.

13. Bad Weather. Supercar will not operate tours during inclement weather. If Supercar feels that the weather may make the safe operation of the vehicles a challenge, then the event will be rescheduled. If bad weather results in cancellation, then Supercar will apply entrant's fees towards another venue.

13. Availability of Scheduled Vehicles. Supercar shall make reasonable efforts to have the advertised vehicles available for use by the customers. However, given the unpredictable nature of operating equipment, substitution may be necessary.
